Introduction

1.1. Createomoto respects the intellectual property rights of others and expects users of createomoto.com to do the same. This Copyright Policy outlines our procedures for addressing copyright infringement allegations regarding content available through the Site.

1.2. This policy is intended to comply with the Digital Millennium Copyright Act ("DMCA") and other applicable copyright laws. It is our policy to respond to notices of alleged infringement that comply with the DMCA and other applicable laws.

Reporting Copyright Infringement

2.1. If you believe that your copyrighted work has been infringed upon, or if you believe that copyright infringement is occurring on the Site, please provide us with a written notice (email is acceptable) containing the following information:

Identification of the copyrighted work claimed to have been infringed or, if multiple copyrighted works are covered by a single notification, a representative list of such works.

Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material.

Information reasonably sufficient to permit us to contact you, such as an address, telephone number, and, if available, an email address at which you may be contacted.

A statement that you have a good-faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.

A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Counter-Notification

3.1. If you believe that material you posted on the Site was removed or access to it was disabled by mistake or misidentification, you may file a counter-notification and send it to our Copyright Agents at support@createomoto.com.

3.2. The counter-notification must be a written communication that includes the following:

Your physical or electronic signature.

Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.

A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.

Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located or, if your address is outside the United States, for any judicial district in which we may be found, and that you will accept service of process from the person who provided notification under the DMCA or an agent of such person.

3.3. Please send your counter-notification to the Copyright Agent listed in Section 2.2 above.

Repeat Infringers

4.1. We may, in appropriate circumstances, terminate the accounts of users who are determined to be repeat infringers. If you believe that a user of the Site is a repeat infringer, please follow the instructions in Section 2 above to report copyright infringement.

Amendments

5.1. We may amend this Copyright Policy from time to time. Any material changes will be effective immediately upon posting of the updated policy on the Site.
